Same-sex marriage: Will Supreme Court’s ‘Constitutional Declaration’ pave the way to equality?
On May 9, the Supreme Court, while in the midst of hearing arguments seeking judicial recognition of the right to same-sex marriage, suggested that it could make a “constitutional declaration”, locating the right to marriage as part of a citizen’s fundamental rights recognised in the Constitution.
The apex court wants to deal with rights as part of the constitutional framework of ensuring ‘life and personal liberty’, rather than dealing with them as a separate, abstract application to be made to specific circumstances.
